Three Sacramento Businesses Sue State Over Current Stay-At-Home Order

Three local Sacramento businesses are taking the state to court in an attempt to overturn the current stay-at-home order in the Great Sacramento Region.

The businesses involved are 58 Degrees & Holding Co., Sparkle Nail Bar, and Visage Salon, according to the Sacramento Business Journal.

The lawsuit was filed on Monday, December 14 with Sacramento law firm Gavrilov & Brooks representing the plaintiffs.

It names Governor Gavin Newsom, the California Department of Public Health, Sacramento County's Department of Health Services, and Public Health Officer Dr. Olivia Kasirye.

The businesses allege that the state of California and county of Sacramento's stay-at-home orders "are arbitrary, capricious, irrational and not reasonably tailored to achieve a compelling governmental interest." The complaint goes on: "The lockdown orders are draconian, dictatorial and fundamentally un-American."

The also allege racism, saying that orders are "the product of institutional racism, and that they and members of their communities are unfairly targeted and disproportionally affected by the stay-at-home and shut-down orders."

Many businesses have sued state and local officials over COVID-19 restrictions throughout the pandemic. Most cases have been dismissed by judges.

The Greater Sacramento region entered the state mandated stay-at-home order on December 10 when the region's ICU capacity dropped below 15%.

The stay-at-home order will last three weeks regardless if the ICU capacity jumps back above the threshold.

After the three week period, state officials will see if ICU capacity is projected to stay above 15% and let business operations resume accordingly.
