On the heels of a breach of customer security at Target, comes a lawsuit. 

The suit was filed in Federal Court in San Francisco just hours after the Target story broke.

Plaintiff Jennifer Kirk's suit says, "Target failed to implement and maintain reasonable security procedures and practices appropriate to the nature and scope of the information compromised in the data breach."

Upward of 40 million customers have had debit and credit card information stolen when a computer virus allowed hackers to access point-of-sale credit card terminals between Nov. 29 and Dec. 15.

Kirk is hoping to make her litigation a class-action suit. Target is not commenting.
