The City of Sacramento is preparing to go to court to aquire land needed to develop the proposed Entertainment and Sports Center.

Sacramento City Council is set to consider using eminent domain to aquire the former Macy's Building in the continuing effort to build a downtown arena,

"We are taking this step, because we've been unable to negotiate a mutually acceptable acquisition of the property at 600 K," said assistant city manager John Danberg.

If approved at the January 7th meeting, the matter will be taken to court, and from there,

"...if the courts determine that it is in the public's interest and the public has the right to acquire the property, then they will grant posession," Danberg added.

An eminent-domain filing wouldn't prohobit continued negotiations nor would it affect the city's financial participation in the project.
